General

OyenCov is a software-as-a-service provided by Estimado Pte Ltd. It is described in the Services section below.

Company (also referred to as "we", “our”, “us”) refers to Estimado Pte Ltd (Singapore UEN: 202216251R), 160 Robinson Road #14-04 Singapore Business Federation Center, Singapore 068914.
User (also referred to as “you”, “your”, “yours”) refers to you as the individual, organization, and the project.
Website refers to oyencov.com, its subdomains, and all the contents, services provided through them. It is currently not available, and under active development.

OyenCov is a technology product under active development that aims to provide reports of an experimental usage-weighted test coverage, and highlight the parts of codebase that may require more engineering attention and test coverage.
For us to generate the reports, we will need to collect the following information, raw telemetry data through either automatic or manual means:
1. Test coverage: Generated by the Simplecov library, usually sent from your continuous integration environment.
2. Runtime coverage: Profiled in production runtime by oyencov client-side library in their respective programming language environments.
We reserve the right at any time, and without notice and liability to you, to modify our Website and Services.

The Company is not in the business of selling our customers’ data. We will not sell your data to any third party. We ensure that the usage of customers’ data will be kept confidential and will only be utilized for work purposes or to facilitate any legal requirements.
We reserve the rights to use 3rd party trackers and analytics on our websites for the purpose of our product research, improvements, and marketing and you are deemed to have provided your consent to this when engaging our services.
When you contact us for support, you grant us the right to access your account, data, contents, information and all other confidential information temporarily in order for us to render assistance and facilitate the provision of services to you.
We may use your Company’s name and/or logo on our marketing materials, with written consent from you and within the bounds of any existing Non-Disclosure Agreements and Privacy Policies signed.
During the free public preview period, you grant us the right to study how you use our application, websites in order for us to improve our offerings. We will take appropriate precautions to safeguard your data.

All the source codes, test coverage data, runtime coverage data, and anything else collected from your environments, repositories, contents (collectively known as “contents”) generated by you are your properties, notwithstanding our possession, usage and access to these contents.
You grant us the license to collect, store, process, display, access, possess the contents that you provided in order for us to render our services to you. We may make backups and archive said contents.

We retain ownership of all our intellectual property rights, including but not limited to trademark, copyright and patents related to our branding identity, website, services, and etc. You may not duplicate, recreate, reuse any visual identity, HTML/CSS/JS codes, and concepts without our explicit approval and authorization.

We provide the Website and the Service “as is” and “as available,” without warranty of any kind. Without limiting this, we expressly disclaim all warranties, whether express, implied or statutory, regarding the Website and the Service including without limitation any warranty of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement in respect of your business or any particulars stated in your platform.
Whilst the Website and Service provided by us is legal and in accordance with the features presented, we do not warrant that the Service will meet your expectations and requirements; that the Service will be uninterrupted, timely, secure, or error-free; that the information provided through the Service is accurate, reliable or correct; that any defects or errors will be corrected; that the Service will be available at any particular time or location; or that the Service is free of viruses or other harmful components. You voluntarily assume full responsibility and risk of loss resulting from your downloading and/or use of files, information, content or other material obtained from the Service.

Estimado Pte Ltd shall not be liable to any losses, damages, liabilities, directly or indirectly, incurred by you, as long as our Website and Service comply with the abovementioned terms.
Notwithstanding the abovementioned, in the event that Estimado Pte Ltd agrees to compensate you, the total, aggregate liability to you or any related third-party exceed the amount you pay to us in the 3 months following up to the complaint.
We are not liable for any losses arising from your misuse of our Services, regardless of it being intentional or accidental.
